JB Web Design Privacy Policy

1. This Document

   1. If any conflict exists between information in the JB Web Design Privacy Policy (this document) and other parts of the JB Web Design website or information elsewhere, the JB Web Design Privacy Policy prevails.

   2. If any conflict exists between the JB Web Design Privacy Policy and Australia's National Privacy Principles, the National Privacy Principles prevail.

2. Application of National Privacy Principles

   1. JB Web Design follows Australia's National Privacy Principles (NPP) available at www.privacy.gov.au. In summary:

   2. JB Web Design will collect personal information only in a manner that is fair, lawful and unintrusive. A person is entitled to be told the organisation's name, the purpose of collection, that the person can get access to their personal information and what happens if the person does not give the information.

   3. JB Web Design will use or disclose information only for the purpose for which it was collected unless the person has consented, or the secondary purpose is related to the primary purpose and a person would reasonably expect such use or disclosure, or in circumstances related to public interest such as law enforcement and public or individual health and safety.

   4. JB Web Design will take reasonable steps to make sure that the personal information it collects, uses or discloses is accurate, complete and up to date.

   5. JB Web Design will take reasonable steps to protect the personal information it holds from misuse and loss and from unauthorised access, modification or disclosure.

   6. JB Web Design will maintain a policy document (this document) outlining its information handling practices and make this available to anyone who asks.

   7. JB Web Design must, generally speaking, give an individual access, on request, to personal information it holds about the individual.

   8. JB Web Design must not, generally speaking, adopt, use or disclose an identifier that has been assigned by a Commonwealth Government agency.

   9. JB Web Design will give people the option to interact anonymously whenever it is lawful and practicable to do so.

   10. Email, web chat and file transfer between JB Web Design and clients, as well as web-based content management systems (CMS) involving the clients' websites, may involve software and services that store data outside Australia but usually involve no access to client data by people overseas.

   11. Unless the client requests otherwise, JB Web Design will use a password-protected account to transfer client data to online data backup services that may be overseas but usually involve no accessing of client data by people overseas.

   12. Software and online accounts, products and services may require use of various personal client login or registration or other details in order to function, but usually hold such details securely and usually involve no direct access to client data by people overseas.

   13. JB Web Design will otherwise transfer a client's personal information to a foreign country only where any person receiving the information is a JB Web Design Subcontractor and therefore agrees to follow the JB Web Design Subcontractor Standards except insofar as the client expressly waives that requirement without violating Australian law.

   14. The client may request that personal client information not be used in subcontracting of the client's work, at which point quoted prices may be changed by JB Web Design.

   15. JB Web Design will not collect sensitive information unless the client has consented, or unless it is required by law or in other special circumstances detailed in the National Privacy Principles.

3. Client Product and Service Accounts

   1. The client agrees to provide login details for domain name registration, domain name registration privacy, FTP (or other file management protocol), email, web hosting and other third party product or service accounts of the client as required for JB Web Design to perform services.

   2. JB Web Design clients using a web-based content management system (CMS) that JB Web Design provides agree to share their web hosting account login details with the CMS service.

4. Client Data Security and Backup

   1. JB Web Design will store any relevant client product and service logins in encrypted password management software files on a computer hard drive and an external hard drive.

   2. JB Web Design will, when possible, perform daily backups of client work in progress and client login data to an external hard drive.

   3. JB Web Design will, when possible, perform daily backups of client work in progress and client login data to an online data backup service that may be overseas, unless the client requests that this is not done.

   4. Any storage of client data using an online data backup service overseas will involve a password-protected account that usually involves no access to client data by people overseas.

   5. JB Web Design will prefer to use secure data transfer services to transfer sensitive client files from one site to another, but may also sometimes need to use ordinary email, and may use ordinary email for non-sensitive files.

5. Client Website Statistics

   1. Where JB Web Design has access to client website statistics, it may view those statistics in order to review the performance of client websites or JB Web Design's own services.

6. Other Websites

   1. JB Web Design is not responsible for the privacy policies or practices of other websites, including those relating to third party products and services used by or for the client, and this is the case whether or not hyperlinks relating to those third party products and services exist from or to the JB Web Design website or client websites.

7. Revision of JB Web Design Privacy Policy

   1. JB Web Design reserves the right to revise the JB Web Design Privacy Policy at any time and without prior notice.
